The referendaries of the Warsaw district court did not agree to enter the state of liquidation of Telewizja Polska and Polish Radio into the National Court Register.. Reason? The existence of public media companies is guaranteed by law, and therefore they cannot be put into liquidation under the provisions of the Commercial Companies Code. The management of the Ministry of Culture does not agree with the decisions and intends to appeal against the decision.
Minister Bartłomiej Sienkiewicz stated that the actions of referendaries may be politically motivated. “11 courts ordered the liquidation of state-owned media companies (regional radio stations – ed.), and one court in Warsaw refused. Is it because the head of this court is someone appointed by Judge Piebiak from Ziobro? I don’t know that, but I know that under the law the current liquidators are legal,” said the head of the Ministry of Culture.
The matter of liquidation of public media will now go to court. It means that final ruling regarding this, whether the companies are in liquidation may take as long as two years. Until then, the companies are managed by liquidators appointed by the Minister of Culture.
However, the fate of the applications remains unknown National Media Council regarding entry into the National Court Register Michał Adamczyk and Tomasz Owsiński as members of the TVP management board. According to experts, even the entry of new authorities into the National Court Register will not change the legal situation in companies. This would, however, have political consequences, which is what PiS is counting on. As we hear, such a move would cause considerable chaos and further protests in front of TVP buildings.
