Draft amendment to the Labor Code

Dziemianowicz-Bąk tells the portal that this is the end of sweeping mobbing under the carpet. “Protecting employees against inappropriate behavior, but also protecting superiors against false accusations – these are the main goals of the proposed act,” he emphasizes.
“The act prepared by the Ministry of Labor and Social Policy, in addition to a more clear and precise definition of mobbing, will specify specific requirements for employers in the field of counteracting mobbing, detecting and combating violence in the workplace, and will also significantly increase the possibility of court compensation for harm caused to an employee,” adds the head of the Ministry of Labor. “.
Definition of mobbing
According to Money.pl, the amendment simplifies things definition of mobbing, which after the changes is to be as follows: “Mobbing means behavior consisting in persistent harassment of an employee. Persistence of harassment means that it is repetitive, recurrent or permanent.”
It also introduces an open catalog of premises specifying what it is mobbing. This includes in particular: humiliation or insulting; bullying; underestimating the employee’s professional suitability; unjustified criticism, humiliation or ridicule of an employee; impeding functioning in the work environment in terms of the ability to achieve work results, perform professional tasks, use competences, communicate with colleagues, access to necessary information; isolating an employee or eliminating him from the team.
According to the website, it is to be assumed that these actions may be “physical, verbal or non-verbal” in nature. Courts are also not to examine whether mobbing was intentional or not – it is enough to establish the fact that it occurred.
Mobbing will also be punished more severely. “Currently, an employee who suffered mobbing or terminated his employment contract as a result of mobbing has the right to claim compensation from the employer in an amount not lower than the minimum wage. After the changes, it would be the minimum wage, but for a period of six months,” we read. (PAP)
