Seat belts must always be fastened
Road traffic law leaves no doubt: if the vehicle is equipped with seat belts it’s both driver What passenger is obliged to use them while driving. For driving without wearing seat belts threatens mandate, penalty points and trouble with insurance payment.

Not every passenger must fasten their seat belts
The Road Traffic Law lists situations that exceptionally exempt both drivers and passengers from the obligation to wear seat belts. The following persons are exempt from this obligation:
- person having medical certificate about contraindications to the use of seat belts;
- woman with visible pregnancy;
- instructor or examiner during training or examination;
- policeman, officer Internal Security Agency, Intelligence Agency, Military Counterintelligence Service, Military Intelligence Service, Central Anticorruption Bureau, Border Guard, Customs and Tax Service and Prison Service, soldier of the Armed Forces of the Republic of Poland – when transporting a detained person(s);
- officer of the State Protection Service while performing official duties;
- soldier of the Military Police while performing protective activities;
- medical team while providing medical assistance;
- escort when transporting monetary values;
- a sick or disabled person transported on a stretcher or in a wheelchair;
- child under 3 years of age transported in a M2 and M3 category vehicle, i.e. a vehicle adapted to transport people and luggage, having more than eight seats plus a driver’s seat;
- a child transported under the rules provided for in Art. 2 section 2 of the Act of June 20, 1992 on the rights to discounted travel in public transport (Journal of Laws of 2018, item 295), i.e. a child up to 4 years old transported on the lap of an adult;
- taxi driver when carrying a passenger.
The passenger must, the taxi driver should
One of the most common causes of tension between taxi drivers and passengers is seat belts. Despite this, the vast majority of transports begin with the passenger fastening his seat belt and end with him being safely delivered to his destination. However, this is not always the case. The legislator allowed taxi drivers to drive without seat belts for security reasons. In time potential attack the taxi driver does not have to waste time unfastening them, thanks to which can immediately leave the vehicle and call for help.
Ticket for the passenger. Penalty points and a fine for the driver
Police strictly punishes drivers and passengers caught not wearing seat belts. Overlays Penalty tickets in the amount of PLN 100 for each passenger and driver, and additionally 5 penalty points for the driver.
Additionally, the driver of a passenger car and all passengers transported by him may not wear seat belts basis for refusing to pay compensation under third party liability insurance by the insurer.
